Foster had applied for primary care of five-year-old Usher V and four-year-old Navivyd Ely, claiming that the R&B star was effectively an absent parent.
Usher V was recently hospitalised after nearly drowning in a swimming pool accident.
Usher, Foster and the singer's aunt Rena Oden all took the stand during the hearing in Atlanta - and the judge eventually dismissed Foster's argument.
According to Digital Spy, the singer and Foster were seen to hug at the end of the hearing, with Usher telling her "I'm sorry".
Usher V is expected to be released from hospital this weekend.
